US Government Sued Over Deportation of Texas Mother with DACA Status
A Texas mother of three has filed a lawsuit against the US government after being notified that her DACA status will be terminated due to 'unauthorized travel'. Jessica Treviño, 34, was deported to Mexico in March after being followed by federal agents and arrested with her husband at a Home Depot parking lot. As a recipient of the Deferred Action for Childhood Arrivals program, she had been living and working in the US since receiving DACA status at age 20.
Treviño's deportation is part of a pattern, according to advocates for DACA recipients. The Trump administration has deported 86 DACA recipients and arrested 241 others, with one DHS letter citing that Treviño knowingly accepted voluntary departure and waived appeal.
However, Treviño claims she did not sign any forms at the ICE detention facility and did not want to be deported. Her lawyer is seeking a federal judge's intervention to reinstate her DACA status and allow her to return to the US with her three children, who are U.S. citizens living on the other side of the border.
