Whole Foods employees who wear Black Lives Matter (BLM) apparel may face disciplinary action after a recent federal labor board ruling. The National Labor Relations Board (NLRB) found that Whole Foods' ban on BLM gear does not violate federal labor law, siding with the Amazon-owned grocery store over workers who wore BLM shirts, masks, and accessories in 2020.

The decision follows complaints filed after employees in several states were disciplined or fired for refusing to remove their BLM messages. In response, Whole Foods revised its workplace dress code policy in 2020 to prohibit the wearing of items with 'printed' images or words, which was seen as an expansion of the original policy.

The ruling is a significant win for Whole Foods, allowing the company to enforce its dress code and discipline employees who refuse to comply. The decision also marks a distinction from the NLRB's 2024 ruling against Home Depot, where workers were allowed to wear BLM messages on their aprons due to complaints about racial harassment.

Board member David Prouty, the lone Democrat on the panel, dissented from part of the decision, arguing that Whole Foods improperly broadened its policy by removing the word 'printed', allowing it to prohibit accessories such as pins and buttons.
