Xinuos Software Copyright Suit Against IBM Dashed by Second Circuit
Xinuos Inc.'s bid to revive its software copyright suit against International Business Machines Corp. has been thwarted by the US Court of Appeals for the Second Circuit.
The court ruled that Xinuos' lawsuit, filed decades after a joint-development agreement with IBM, was time-barred, meaning it was filed too late to pursue its claims.
The dispute centers on a joint development agreement (JDA) between Xinuos and IBM. The US Court of Appeals for the Second Circuit held that Xinuos' copyright allegations against IBM were not analogous to either copyright infringement or ownership claims.
