EPA's Emergency Fuel Waiver Exposed as Long-Term Policy Shift

On August 20, the Environmental Protection Agency (EPA) and the Department of Energy issued a temporary emergency fuel waiver that allows refiners to sell higher-volatility E10 gasoline starting September 1. According to Administrator Lee Zeldin, this move will 'provide relief at the pump' and strengthen the nation's gasoline supply chain.

However, a closer look at the EPA's own paperwork reveals that this is not a one-time fix, but rather the latest entry in a waiver campaign that has been ongoing since May 1. The agency has issued these waivers every few weeks, with no signs of stopping, effectively turning what was initially an emergency into a policy.

The EPA has capped Reid Vapor Pressure (RVP) for gasoline between June 1 and September 15 to prevent more volatile fuel from evaporating and contributing to ground-level ozone pollution. However, the recent waiver allows refiners to treat the back half of summer like it's already fall, when looser volatility rules normally apply.

The mechanism behind this move is not an increase in crude oil production, but rather the ability for refiners to blend more butane into gasoline without breaking the RVP limit. Butane costs significantly less than crude-derived components and allows refiners to stretch their supply pool, creating the illusion of additional barrels per day.
