Attorney General Gentner Drummond has secured a significant victory in his lawsuit against NextEra Marketing. An Osage County judge ruled that the company had violated Oklahoma law by charging excessive prices for natural gas during Winter Storm Uri, which occurred in February 2021.

The court granted Drummond's motion for partial summary judgement and found NextEra liable under both the Oklahoma Emergency Price Stabilization Act and the Oklahoma Consumer Protection Act.

According to Drummond's office, the amount of damages, including overcharges, restitution, and disgorgement, will be determined at trial. The ruling comes after the Federal Energy Regulatory Commission dismissed a petition from NextEra seeking federal jurisdiction over issues raised in Drummond's lawsuit.

This decision marks an important step towards holding energy marketers accountable for artificially inflating natural gas prices during emergencies. Drummond has filed several lawsuits against energy marketers alleging they exploited Oklahomans during Winter Storm Uri.
