Aave Labs Proposes Cayman Islands Foundation to Oversee Brand and IP
Aave Labs has proposed the creation of a Cayman Islands foundation to oversee the brand and intellectual property of the Aave lending protocol. The 'Aave Foundation, Phase 1' proposal is currently at the Aave Request for Final Comments (ARFC) stage, which would fund the foundation's formation and initial independent appointments. Transfers of the trademark, domains, and codebase IP would be made in separate proposals.
The proposed foundation would hold the Aave trademark, primary domains, protocol codebase IP, and IP assigned under service-provider agreements. The World Intellectual Property Organization's database lists Estonian entity Quantum Swan OÜ as the holder of a U.S. $AAVE wordmark registration. Assignment of new code, tooling, models, and documentation would become a standard condition for provider engagements.
An independent director would manage the foundation, overseen by an independent supervisor unaffiliated with the director. Aave Labs, DAO service providers, and their affiliates would be barred from holding these roles. The DAO would appoint and remove directors through Aave Improvement Proposals (AIPs) after the initial appointments.
