Austria Fines Bitpanda EUR 70,000 for MiCAR Disclosure Violations
Austria's Financial Market Authority (FMA) fined Bitpanda GmbH EUR 70,000 for violating Markets in Crypto-Assets Regulation (MiCAR). The penalty concerns the timing and content of disclosures for a crypto-asset after authorization.
The FMA found that Bitpanda did not send the white paper to the regulator at least 20 working days before publishing it. The company also distributed marketing material that omitted required statements, including no European Union authority had reviewed or approved it and the offeror was solely responsible for its content.
Bitpanda had obtained authorization as a crypto-asset service provider on April 9, 2025. However, the FMA's penalty does not concern custody of customer assets or access to withdrawals.
