Austria's Legacy Crypto Holdings Still Hold Tax Advantages
The tax advantages of older Bitcoin holdings in Austria are still significant five years after the introduction of new crypto tax laws. For investors who acquired their coins before February 28, 2021, the sale of those assets can be tax-free, unlike newer holdings which are taxed at a flat rate of 27.5 percent.
The key date is February 28, 2021, after which new crypto tax laws came into effect in Austria. Coins acquired before this date generally fall under transitional rules and the old speculative period applies.
For example, an investor who bought Bitcoin for 10,000 euros in 2020 and sold it for 80,000 euros in 2026 would still be eligible for a tax-free sale if the coins can be proven to have been acquired before February 28, 2021. This is because the speculative period that applied at the time has long expired.
However, swaps made in the meantime, lending, or other yield models can complicate matters and render legacy status invalid. It's also crucial for investors to document their entire chain of transactions, including purchase statements, bank transfers, wallet addresses, blockchain transactions, and earlier crypto-to-crypto swaps.
