Binance Faces EU Regulatory Probe Over Continued Services Amid MiCA Licensure Failure

Binance, the world's largest cryptocurrency exchange, is facing regulatory scrutiny from European authorities over its continued servicing of EU customers despite being instructed to wind down operations in the region. In July, Binance failed to obtain a license under the Markets in Crypto-Assets Regulation (MiCA), which required unlicensed companies to cease activities by that date.

The exemption allows companies based outside the EU to provide services when those customers have approached the company on their own initiative. However, regulators are examining how Binance uses this 'reverse solicitation' exemption and could impose fines if they're not satisfied with the company's responses.

Some regulators have requested information from Binance, which stated that it complies with applicable regulatory requirements in the jurisdictions where it operates. The European Securities and Markets Authority (ESMA) emphasized that supervision is a national authority responsibility and that their role is to promote consistent application of the rules.
