Binance's EU Operations Under Scrutiny Amid MiCA Licensing Dispute
EU regulators are investigating Binance's continued operations in the European Union after the cryptocurrency exchange was ordered to wind down its business due to its failure to obtain a license under the MiCA regime. According to a report by the Financial Times, Binance is relying on a 'reverse solicitation' exemption that allows non-EU financial firms to serve customers who independently initiate a relationship with them.
However, EU regulators have expressed concerns that the exemption is being misused, and national regulators in France, Germany, and Greece are examining Binance's use of the exemption. If regulators conclude that Binance is operating outside the scope of the exemption, they could impose fines or take further enforcement action.
Binance has stated that it is working towards obtaining MiCA authorization and complies with applicable requirements in the jurisdictions where it operates.
The dispute highlights the complexities of the MiCA regime and the need for clear guidelines on the use of exemptions.
