BitMEX Faces Class Action Lawsuit as It Prepares to Shut Down

A class action lawsuit has been filed against BitMEX in New York federal court, accusing the crypto derivatives platform of orchestrating fraudulent liquidations to seize clients' BTC. The complaint, filed on July 24, 2026, claims that BitMEX deliberately designed a system to profit from liquidations, using confidential client information and accessing the market during server freezes. This is not the first time BitMEX has faced such accusations, as a similar class action was voluntarily dropped in June 2025.

The plaintiffs, BKX Services Inc. and David Namdar, seek the return of allegedly confiscated BTC and compensatory and punitive damages. They claim that BitMEX's liquidation mechanism allowed them to profit from clients' losses, transferring excess BTC to their insurance fund rather than returning it to traders. BitMEX has responded by saying they will 'vigorously defend themselves,' citing a history of handling similar complaints.

The timing of the lawsuit coincides with BitMEX's announcement that it will cease operations on September 23, 2026, after eleven years in business. The platform had already begun downsizing, removing trading pairs and derivative products from its offer in July. The closure has caused the BMEX token to collapse by about 90%.
