California Meme Coin Regulation Clears Legislature with Unanimous Votes
California has taken a significant step towards regulating meme coins with Assembly Bill 2409, which aims to prevent public officials from issuing their own digital assets. The bill, authored by Assemblymember Avelino Valencia, cleared the state Assembly by a unanimous vote of 78-0 and the Senate by 40-0 on August 26, 2026.
The bill would prohibit California public officers and certain government employees from issuing meme coins, and block digital asset platforms from listing any officially linked memecoin issued on or after January 1, 2027. The California Legislature's own text adds a new chapter to the Government Code addressing prohibited digital financial transactions.
Analysts following crypto news say that Governor Gavin Newsom's decision to sign or veto the bill could become a template for other states to copy for regulating politician-linked tokens. The restriction only reaches tokens issued on or after January 1, 2027 by a covered official, with coins launched earlier exempt under this grandfather clause.
The TRUMP token, launched in January 2025 and currently holding a market cap of roughly $6898.479 million, is an example of a meme coin that would be unaffected by the new regulation.
