CFTC Begins Rulemaking Process for Leveraged Retail Crypto Markets
The Commodity Futures Trading Commission (CFTC) has initiated an advanced rulemaking process to address retail commodity transactions involving crypto assets. This step is part of a broader effort to establish a more comprehensive federal framework for leveraged and margined retail crypto markets.
On October 5, the CFTC published an Advanced Notice of Proposed Rulemaking (ANPR) focused on retail crypto transactions. The document opens a consultation process rather than imposing immediate rules. The CFTC seeks public input on how crypto asset transactions should fit into a uniform national market framework, covering areas like intermediaries, customer protections, market integrity, and the structure of regulated trading venues.
This rulemaking centers on Section 2(c)(2)(D) of the Commodity Exchange Act, which governs leveraged, margined, or financed retail commodity transactions. The CFTC aims to create a purpose-built structure for these transactions, as the current patchwork of state and federal regulations has proven inadequate for the rapidly evolving crypto market.
The ANPR is an early-stage step and does not automatically create a new category of licensed crypto venues. The CFTC will consider public comments to shape the next proposal, and any binding framework will need to go through the agency’s rulemaking process. This marks a shift from the CFTC’s previous case-by-case approach to applying older commodity law to the retail crypto market.
