CFTC Blocks NY Shutdown Bid as Prediction Market Battle Escalates
The Commodity Futures Trading Commission (CFTC) invoked emergency powers to protect Kalshi's New York operations, amid ongoing legal pressure from state prosecutors. On July 31, New York filed a lawsuit against Kalshi, alleging that the platform operates unlicensed gambling services through sports prediction offerings.
The state prosecutors are seeking a minimum of $36 billion in damages, plus additional penalties potentially tripling the company's profits. Federal authorities contend that their regulatory framework exclusively governs prediction market oversight, superseding state-level gambling statutes.
Federal regulators have now initiated litigation against nine states collectively to preserve their prediction market authority. The CFTC Chair Michael Selig stated that congressional intent never envisioned derivatives exchanges navigating conflicting state gambling regulations.
