CFTC Exempts Crypto Software Providers From Broker Registration Requirements

Share

The US Commodity Futures Trading Commission (CFTC) has issued a no-action letter to exempt eligible crypto and prediction markets software providers from broker registration requirements.

This move is significant, as it provides clarity for developers partnering with regulated platforms. To be eligible, the developer must maintain zero discretion over trades, never assume custody of users' assets, and not take volume-based dynamic commissions.

The CFTC had previously set a precedent for this kind of regulation by granting a no-action position to Phantom Technologies in March. The development is seen as a positive step forward for safe, compliant, and non-custodial consumer financial access.
