CFTC Expands Crypto Trading Via Online Platforms for Select Software Providers
The Commodity Futures Trading Commission (CFTC) has moved to expand crypto and prediction market trading via online platforms.
In staff guidance issued on September 17, 2026, the CFTC said that 'passive software' providers partnering with regulated entities wouldn't face enforcement penalties for failing to register as brokers, so long as they never take custody of a user's assets.
The exemption applies only to these specific software providers and does not affect other types of companies or individuals involved in the crypto and prediction markets.
