CFTC Moves to Regulate Leveraged Retail Crypto Trades
The Commodity Futures Trading Commission (CFTC) has proposed a new regulatory framework for leveraged retail crypto trades, aiming to integrate digital asset transactions into its national market structure. The Advanced Notice of Proposed Rulemaking, unveiled on Monday, seeks public input over a 60-day period to shape future formal rules. The proposal introduces a dedicated registration subcategory called a "crypto asset market" for platforms offering leveraged, financed, or margin trades, establishing standards to prevent fraud before it occurs.
CFTC Chairman Michael Selig emphasized the need for clarity and consumer protections in the crypto markets, stating that the agency is committed to delivering these by incorporating crypto transactions into its regulatory framework. The initiative comes amid legislative stagnation in Congress, where the broader Clarity Act has stalled, prompting regulators to use existing legal frameworks instead of waiting for comprehensive congressional action.
The proposed rules target major digital asset venues like Coinbase Global Inc (NASDAQ: COIN), Crypto.com, and Robinhood Markets Inc (NASDAQ: HOOD), which facilitate leveraged consumer trading. Under the CFTC's proposal, these venues can register under standard designated contract market rules, signaling an effort to accommodate emerging derivatives and event-driven instruments within existing frameworks.
