CFTC Proposes Federal Framework for Crypto Exchanges
The U.S. Commodity Futures Trading Commission (CFTC) has unveiled a new proposal aimed at creating a federal regulatory framework for cryptocurrency exchanges that offer leveraged digital asset trading. Announced on Monday, the proposal would allow these exchanges to opt for federal oversight instead of relying on varying state money-transmitter licenses.
This move comes in the wake of Congress's recent failure to advance comprehensive crypto regulation. By choosing the new framework, exchanges would operate under a single set of federal rules, avoiding the complexities of meeting different state requirements. Industry participants have long argued that the current state-by-state approach imposes an excessive burden.
The proposed rules leverage the CFTC’s existing authority to oversee margined or leveraged spot assets. Currently, the spot cryptocurrency markets lack clear regulatory guidelines. While the CFTC has sought authority to regulate these markets, only Congress has the power to grant such authority.
The new rules would introduce a distinct category of CFTC-regulated trading venues called a "crypto asset market" specifically for exchanges offering leveraged or margined trading to retail customers.
