CFTC Proposes Federal Framework for Leveraged Crypto Trading
The US Commodity Futures Trading Commission (CFTC) proposed a new federal framework on Monday for cryptocurrency exchanges offering leveraged digital asset trading. This move aims to bring parts of the spot crypto market under federal oversight following Congress’s failure to advance comprehensive crypto regulation.
The proposed rules would allow US crypto exchanges to opt into a federal regulatory framework instead of relying on state money-transmitter licenses. The CFTC is leveraging its existing authority to oversee margined or leveraged spot assets, a step the agency has long sought but requires Congressional approval to fully regulate spot cryptocurrency markets.
Under the proposed rules, a new category of CFTC-regulated trading venues called 'crypto asset markets' would be established for exchanges offering leveraged or margined trading to retail customers. These platforms would need to implement anti-market-manipulation controls and provide proof of reserves. The CFTC is also proposing that registered futures commission merchants intermediate customer trades on these exchanges.
The proposed rules come in the wake of Congress’s inability to pass the Clarity Act, which would have created new rules for the $2 trillion cryptocurrency market. Without legislative backing, regulations could face challenges from shifting political climates and court battles, posing risks for the crypto industry.
