CFTC Proposes Federal Oversight for Leveraged Crypto Trading
The US Commodity Futures Trading Commission (CFTC) has proposed a new federal framework for cryptocurrency exchanges that offer leveraged digital asset trading. This move aims to bring parts of the spot crypto market under federal oversight, following Congress's failure to advance comprehensive crypto regulation. The proposed rules allow US crypto exchanges to opt into a federal regulatory framework instead of relying on state money-transmitter licenses.
The CFTC's proposed rules would establish a new category of CFTC-regulated trading venues called a 'crypto asset market' for exchanges offering leveraged or margined trading to retail customers. These platforms would be subject to specific requirements, including anti-market-manipulation controls and a 'proof of reserves' obligation. The CFTC is also proposing that registered futures commission merchants intermediate customer trades on these new exchanges.
CFTC Chairman Michael Selig stated, 'For years, entrepreneurs building on the new frontier of finance faced uncertainty about whether there was a place for them in our markets. We are giving them an answer.' The proposed rules come after Congress failed to advance the Clarity Act, which would have provided explicit authority for the CFTC to police the spot crypto market.
Analysts have noted that without legislation, regulations could be vulnerable to political shifts and court challenges, creating lingering hazards for the crypto industry. The CFTC is not stipulating specific leverage limits, but any exchange offering leveraged transactions would need to clear that product with CFTC staff.
