CFTC Proposes Federal Oversight Framework for Crypto Exchanges
The U.S. Commodity Futures Trading Commission (CFTC) has proposed new federal oversight rules for cryptocurrency exchanges offering leveraged digital asset trading. The move aims to bring parts of the spot crypto market under federal regulation following Congress's failure to pass comprehensive crypto regulation.
Under the proposed framework, U.S. crypto exchanges can opt into a federal regulatory regime instead of relying on state-by-state money-transmitter licenses. This would allow them to comply with a uniform set of federal rules, which many industry participants have argued is less burdensome than navigating different state regulations.
The CFTC's proposed rules leverage its existing authority to oversee margined or leveraged spot assets. CFTC Chair Michael Selig emphasized the importance of providing clarity for entrepreneurs in the crypto space, stating, 'For years, entrepreneurs building on the new frontier of finance faced uncertainty about whether there was a place for them in our markets. We are giving them an answer.'
Exchanges that opt into the new framework would be categorized as 'crypto asset markets' and would need to adhere to specific requirements, including anti-market manipulation controls and a 'proof of reserves' obligation. The CFTC also proposed that customer trades on these exchanges be intermediated through registered futures commission merchants.
