CFTC Proposes Federal Oversight Framework for Leveraged Crypto Trading
The U.S. Commodity Futures Trading Commission (CFTC) has proposed a new federal oversight framework for cryptocurrency exchanges offering leveraged or margined digital asset trading to retail customers. This move comes after Congress failed to advance broader crypto legislation recently. The proposal allows exchanges to opt into a unified federal regulatory regime instead of dealing with a patchwork of state-level licensing rules.
Under the proposed framework, participating exchanges would comply with federal regulations, including anti-market-manipulation controls and proof-of-reserves requirements. CFTC Chair Michael Selig mentioned that the plan aims to reduce uncertainty for firms developing crypto market businesses. The regulator would create a new category of CFTC-supervised trading venues called a 'crypto asset market.'
The proposal highlights the CFTC's limited authority over spot crypto markets, as only Congress can grant broader regulatory powers. While the CFTC has sought broader authority, it must currently work within narrower existing powers. The industry has long argued that the current system of state-by-state licensing is burdensome, and this proposal aims to streamline the regulatory process for leveraged crypto trading platforms.
