CFTC Proposes New Federal Framework for Leveraged Crypto Trading
The U.S. Commodity Futures Trading Commission (CFTC) unveiled a new federal framework on Monday for cryptocurrency exchanges that provide leveraged trading, aiming to bring parts of the spot crypto market under federal oversight. This proposal comes after Congress failed to pass comprehensive crypto regulation. The new rules would allow U.S. crypto exchanges to opt into federal oversight instead of relying on a mix of state licenses.
The CFTC's proposed rules leverage its authority to oversee margined or leveraged spot assets. CFTC Chairman Michael Selig announced the initiative during a speech at Fordham University's law school in New York. He stated, 'For years, entrepreneurs building on the new frontier of finance faced uncertainty about whether there was a place for them in our markets. We are giving them an answer.'
Under the proposed framework, a new category called 'crypto asset market' would be created for exchanges offering leveraged trading. These platforms would need to implement anti-market-manipulation controls and proof of reserves. The CFTC is also proposing that registered futures commission merchants handle customer trades on these exchanges, without setting specific leverage limits.
The proposed rules follow the failure of Congress to advance the Clarity Act, which would have provided regulatory clarity for the $2 trillion cryptocurrency market. Analysts warn that without legislation, regulations could face political shifts and legal challenges, posing risks for the crypto industry.
