CFTC Proposes New Federal Oversight for Leveraged Crypto Trading
The U.S. Commodity Futures Trading Commission (CFTC) has proposed a new federal framework for cryptocurrency exchanges offering leveraged digital asset trading. This move aims to bring parts of the spot crypto market under federal oversight following Congress's failure to advance comprehensive crypto regulation.
The proposed rules would allow U.S. crypto exchanges to opt into a federal regulatory regime instead of relying on state money-transmitter licenses. Exchanges that choose this framework would follow a uniform set of federal rules, reducing the burden of varying state regulations. The CFTC is leveraging its authority over margined or leveraged spot assets to establish this new framework.
CFTC Chair Michael Selig announced the proposal at an event held by Fordham University’s law school. He stated, "For years, entrepreneurs building on the new frontier of finance faced uncertainty about whether there was a place for them in our markets. We are giving them an answer." Under the new rules, a "crypto asset market" category would be created for exchanges offering leveraged or margined trading to retail customers, with requirements including anti-market manipulation controls and a "proof of reserves" obligation.
The CFTC is also proposing that customer trades on these exchanges be intermediated through registered futures commission merchants.
