CFTC Proposes New Framework for Leveraged Retail Crypto Trades
The Commodity Futures Trading Commission (CFTC) has taken a significant step toward regulating leveraged retail crypto trades. On Monday, the agency proposed a new framework under the Commodity Exchange Act to bring crypto trading into its national market structure. This initiative includes a 60-day public comment period to refine the rules before they become formal.
The proposed framework introduces a dedicated registration category called a "crypto asset market" for platforms offering leveraged, financed, or margin trades. The goal is to set industry standards and enhance oversight to prevent fraud before it occurs, rather than reacting after the fact.
CFTC Chairman Michael Selig emphasized the need for clarity and consumer protections in the crypto market. He stated that the agency is committed to integrating crypto transactions into its regulatory framework, fulfilling administrative directives to build a comprehensive federal market structure.
The move comes as Congress struggles to pass broader legislation, such as the Clarity Act, which would have granted the CFTC explicit oversight over digital assets classified as commodities. Instead, the CFTC is leveraging existing legal frameworks to advance its regulatory goals.
Major platforms like Coinbase Global Inc, Crypto.com, and Robinhood Markets Inc are directly affected by the proposed rules. These platforms currently facilitate leveraged consumer trading, and the new framework aims to accommodate emerging derivatives and event-driven instruments within existing institutional frameworks.
