CFTC Proposes New Rules for Leveraged Crypto Trading
The US Commodity Futures Trading Commission (CFTC) has proposed a new federal framework for cryptocurrency exchanges that offer leveraged digital asset trading. This move aims to bring parts of the spot crypto market under federal oversight following Congress's failure to pass comprehensive crypto regulation. The proposed rules would allow US crypto exchanges to opt into a federal regulatory framework instead of relying on state money-transmitter licenses.
Under the proposed rules, the CFTC would create a new category of regulated trading venues called 'crypto asset markets' for exchanges offering leveraged or margined trading to retail customers. These platforms would need to meet specific requirements, including anti-market-manipulation controls and a 'proof of reserves' obligation. The CFTC is also proposing that registered futures commission merchants intermediate customer trades on these exchanges.
The proposed rules come after Congress failed to advance the Clarity Act, which would have provided explicit authority for the CFTC to regulate the spot crypto market. The impasse has shifted the responsibility to crypto-friendly regulators like the SEC and CFTC to provide regulatory clarity. Analysts warn that without legislation, regulations could be vulnerable to political shifts and court challenges, creating ongoing risks for the crypto industry.
