The Commodity Futures Trading Commission (CFTC) has proposed updates to its rules governing commodity pool operators and commodity trading advisors. The proposal aims to modernize the definition of Qualified Eligible Persons (QEPs) by adjusting portfolio thresholds to reflect market growth. This change is intended to codify informal relief for registered investment advisers managing private funds that qualify as QEPs, potentially easing registration requirements.
The CFTC also plans to streamline reporting for funds-of-funds to reduce duplicative filings. These changes are expected to impact compliance costs and operational flexibility for fund managers but do not address digital assets, leaving crypto-related regulatory issues separate. The public has a 60-day window to comment on the proposal.
