CFTC Pushes Crypto Rules After Congressional Setback
The U.S. Commodity Futures Trading Commission (CFTC) is moving forward with proposals to expand its oversight of cryptocurrency markets, following the recent failure of the Clarity Act in Congress. The CFTC argues that it already has broad authority under the Commodity Exchange Act to regulate spot crypto markets. However, the Clarity Act, which would have formally codified this authority and structured CFTC oversight of digital commodity markets, did not pass.
CFTC Chair Michael Selig highlighted the commission's intent to bring certain margined and leveraged cryptocurrency transactions and exchanges under its regulatory purview. This move comes as the agency seeks to assert its role in the rapidly evolving crypto landscape despite the lack of legislative clarity.
The CFTC's push for regulatory control underscores the ongoing debate over how to effectively govern digital asset markets. Without explicit legislative mandates, the commission is relying on existing legal frameworks to justify its actions, which could lead to further legal and regulatory challenges in the future.
