CFTC Seeks Feedback on Leveraged Crypto Trading Regulations
The Commodity Futures Trading Commission (CFTC), the US regulator for futures and derivatives markets, launched a 60-day consultation on leveraged crypto trading on October 5, 2026. The consultation, titled 'Advanced Notice of Proposed Rulemaking,' is a 109-page document that asks questions but does not establish any new rules or obligations. CFTC Chairman Michael S. Selig emphasized the need for clarity, reliability, and consumer protection in the crypto markets, aiming to prevent incidents like the collapse of FTX.
The document does not create any specific obligations or force anyone to trade crypto assets on a CFTC-registered venue. It focuses on two key areas: Regulation CTX, which deals with the interpretation of terms like 'offer' and 'actual delivery,' and Regulation CAM, which describes a new type of trading venue for leveraged crypto assets. The CFTC seeks feedback on six main topics, including listing standards, position limits, and the custody of client assets.
Contrary to some reports, the document does not impose a duty to prove reserves. Instead, it asks for comments on current practices and potential safeguards for segregated client assets. The consultation also does not set an upper limit for leverage, leaving the margin regime open for discussion.
