CFTC Seeks Public Input on Crypto Market Regulations
The Commodity Futures Trading Commission (CFTC) has taken a major step towards regulating crypto asset transactions in the United States. On October 5, 2026, the agency published an Advanced Notice of Proposed Rulemaking (ANPRM) to seek public comments on establishing a comprehensive regulatory framework for crypto transactions (CTXs).
CFTC Chairman Michael S. Selig emphasized the importance of this move, stating that it is a critical step in ensuring the U.S. remains the global leader in crypto markets. The goal is to provide clarity, certainty, and consumer protections for crypto asset markets by incorporating them into the agency's uniform national market regulatory framework.
The ANPRM solicits comments on several key areas, including how to prevent abusive practices in crypto markets, provide industry-specific information to market participants, and codify regulations tailored for crypto asset markets. The Commission aims to use the feedback to inform future rulemakings under section 2(c)(2)(D) of the Commodity Exchange Act.
Comments on the ANPRM must be submitted within 60 days of its publication in the Federal Register and will be posted on Regulations.gov. The CFTC's actions align with President Trump's directive to propose a federal crypto asset regulatory market structure using the agency's existing authorities.
