CFTC Seeks Public Input on New Crypto Trading Rules
The Commodity Futures Trading Commission (CFTC) has initiated a public comment period on potential new rules for retail cryptocurrency transactions. The agency is seeking input on consumer protections, regulatory clarity, and a new category for crypto markets. Comments must be submitted within 60 days of the Advance Notice of Proposed Rulemaking (ANPRM) being published in the Federal Register.
The proposed framework aims to bring certain U.S. crypto transactions under CFTC oversight using existing authority under the Commodity Exchange Act (CEA). This move follows the Senate's failure to advance the CLARITY Act, which would have expanded the CFTC's role in regulating digital assets. The potential changes focus on leveraged, margined, or financed crypto transactions rather than outright purchases.
CFTC chairman Michael S. Selig emphasized the importance of ensuring America remains a leader in crypto. He stated that the agency is committed to delivering clarity, certainty, and consumer protections by incorporating crypto transactions into its regulatory framework. The CFTC already regulates crypto derivatives and can take enforcement action against illegal activity.
The proposal includes considerations for new consumer protections, anti-fraud measures, and a new registration category for crypto markets. The agency aims to be more proactive in preventing abusive practices and fraudulent schemes, such as the FTX scandal, rather than relying solely on enforcement after customers have lost money.
