CFTC Taps Existing Authority in Wake of Stalled CLARITY Act

The US Senate's failure to advance the CLARITY Act has put a spotlight on the CFTC's existing authority to regulate the crypto market. The legislation, which aimed to rewrite the legal framework for digital assets, fell short of the required 60 votes.

CFTC Chairman Michael Selig responded by stating that the agency will continue to rely on its existing statutory authorities to provide regulatory clarity and consumer protections in crypto markets.

The CFTC has a established framework for derivatives markets under the Commodity Exchange Act, which gives it several routes for advancing crypto regulation without new legislation. This includes allowing regulated exchanges to list crypto derivatives, requiring companies to demonstrate compliance with Section 5 and Part 38 requirements, and implementing market safeguards such as position limits or accountability requirements.

The agency's rulemaking power is limited by the existing statute, which means it cannot create new statutory jurisdiction simply because legislation failed to pass. However, the CFTC can interpret and implement powers Congress has already delegated to it.
