CFTC Unveils Tailored Crypto Market Regulations with New Guidelines
The US Commodity Futures Trading Commission (CFTC) has unveiled new guidelines for crypto asset markets, marking a significant step in regulatory clarity. Chairman Mike Selig announced the proposal on October 5, following a White House review, fulfilling a pledge made after the collapse of the CLARITY Act. The rules aim to provide a tailored regulatory framework distinct from traditional securities models, which are often seen as restrictive for digital asset markets.
The CFTC proposal includes two key frameworks: Regulation Crypto Asset Transactions (Regulation CTX) and Regulation Crypto Asset Markets (Regulation CAM). Regulation CTX focuses on the derivatives and financing layer, regulating retail crypto trading using leverage and margin. The CFTC defines crypto purchases sent to non-custodial wallets as 'actual delivery' if completed within 28 days, reducing regulatory burdens on self-custody transactions.
Regulation CAM targets market structure and platform registration, offering optional federal licenses for crypto exchanges under the Designated Contracts Management (DCM) system. These licenses mandate operational protections like proof-of-reserves audits and anti-money laundering safeguards. Exchanges with federal licenses can bypass state-level rules and offer leveraged trading, which is otherwise prohibited.
While the proposal has been welcomed as a positive regulatory development, industry lawyers caution that the guidelines lack permanence. Changes in agency leadership or presidential administration could alter the rules. Stakeholders and the public have a 60-day window to provide feedback following the proposal's publication in the Federal Register.
