CFTC Will Proceed with Crypto Rules Regardless of CLARITY Act Outcome
CFTC Chair Michael Selig has stated that even if the CLARITY Act fails in Congress, cryptocurrency market-structure rules will still move forward.
Selig made this announcement at the inaugural meeting of the CFTC's Innovation Advisory Committee on August 20. He emphasized that while congressional legislation is the most important step towards 'future-proofing' the industry, failure to pass the bill would not halt the administration's broader effort to establish clearer federal rules for cryptocurrency markets.
The CLARITY Act aims to provide a framework defining the jurisdictional boundary between the SEC and CFTC while establishing statutory principles for digital-asset spot markets. However, Selig noted that without legislation, the CFTC could use existing Commodity Exchange Act authorities, exemptions, interpretive guidance, and rulemaking to address portions of the market.
The agency has already begun doing so through its Crypto Sprint initiative, which has addressed listed spot crypto trading, tokenized collateral, stablecoins, and blockchain-based market infrastructure. The CFTC is also working jointly with the SEC through Project Crypto, an initiative designed to harmonize federal oversight and reduce uncertainty around whether particular crypto assets or transactions fall under securities regulation.
