CLARITY Act Delayed Amid Ethics Dispute Over Enforcement Mechanisms

The Digital Asset Market Clarity (CLARITY) Act, a bipartisan bill aimed at establishing rules for digital asset markets, is facing a delay due to an ongoing ethics dispute. The Senate is set to enter a crucial week in its consideration of the bill, with lawmakers racing against the clock to advance legislation before the August recess.

The main hurdle to the bill's passage is the White House's failure to respond to a bipartisan compromise proposal put forth by Senators Thom Tillis and Ruben Gallego. This proposal would address the largest outstanding issue in the bill and bring much-needed clarity to regulating the crypto industry, according to Coinbase CEO Brian Armstrong.

Armstrong has urged lawmakers to support the bill, describing it as 'a bipartisan effort that represents a ton of work' and emphasizing its importance for America's financial and technological hub status. He noted that 70% of Americans want clear crypto rules and that the bill includes new authorities for banks to integrate stablecoins and crypto.

However, Democrats are pushing for a way to allow state attorneys general to challenge DOJ inaction on ethics enforcement, which is modeled after the Laken Riley Act. The standoff has been ongoing since late July, with Senate Republicans initially proposing ethics provisions that would prohibit federal officials from issuing or sponsoring digital materials, leaving enforcement solely to the Department of Justice.

The bill's fate remains uncertain, with some lawmakers predicting it may slip into September unless a resolution is reached soon. With the August recess approaching on August 10, the window for advancing the legislation is narrowing rapidly.
