Clarity Act Passage Odds Slip as Senate Heads into Recess

The Clarity Act, a bill aimed at clarifying regulatory responsibilities between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC), is facing uncertain passage in 2026. Despite support from Wall Street's biggest names, including BlackRock, Fidelity, Franklin Templeton, Goldman Sachs, and SoFi, the bill's momentum has cooled since its introduction in May last year.

The legislation seeks to settle which agency oversees digital assets, a question that has sparked years of enforcement disputes, lawsuits, and industry frustration. However, with the Senate's August recess just days away, analysts estimate the bill's chances of passing have fallen to roughly 30%.

Regulators warn that if the Clarity Act fails, they will accelerate rulemaking under Project Crypto instead of waiting for Congress. CFTC Chair Michael Selig stated that regulators would be responsible for 'writing all the rules' governing crypto and described the current regulatory setup as a 'patchwork of state laws and regulations' that is 'really bad for business.'

Supporters argue that clear rules would protect investors, boost investor confidence, and help the U.S. remain competitive in the digital asset market.
