Clarity Act Setback Leaves US Crypto Regulation in Limbo
The US crypto industry is facing prolonged regulatory uncertainty after the Senate failed to advance the Clarity Act. This setback leaves digital asset companies without a comprehensive federal market structure framework and keeps the division of authority between the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) unclear.
The lack of legislative clarity has already impacted markets, with Coinbase shares falling about 10% following the vote. Stablecoin issuer Circle also suffered a sharp decline as investors assessed the implications for US crypto regulation.
Industry executives warn that this regulatory gap could affect investment decisions, product launches, and compliance planning. Gate CEO Lin Han noted that capital and talent typically gravitate toward jurisdictions with clearer rules, potentially benefiting regulated crypto businesses in Europe and Asia.
The contrast between the US and overseas is stark, with the European Union implementing its Markets in Crypto-Assets (MiCA) framework and several Asian financial centers developing digital asset regulations. The UK is also preparing comprehensive rules expected to take effect next year.
