CLARITY Act Sparks Regulatory Uncertainty in Crypto Markets

The CLARITY Act aims to reduce overlap between the SEC and CFTC by allowing decentralized digital assets to be regulated as commodities rather than securities. This change could provide a clearer set of rules for exchanges, token issuers, and institutional investors.

Supporters argue that this would make it easier to launch products, list assets, and attract institutional capital without worrying about changing regulatory interpretations. The market is not viewing the CLARITY Act as a short-term stimulus but rather as a possible step toward a more predictable regulatory framework.

However, traditional financial institutions are pushing back against the bill, arguing that it could weaken the SEC's authority over assets with significant investment risk and create a separate regulatory pathway for digital assets that is less demanding than the one banks must follow. Banks also worry about competition from crypto firms gaining clearer access to payment networks, custody, trading, and tokenized financial products.

The Senate's delay of the vote until September has left markets in a state of uncertainty, waiting for policy rather than reacting to it. A successful vote could improve sentiment toward US crypto businesses and strengthen institutional adoption, while another delay or signs of weakening political support could hurt sentiment.
