CLARITY Act Stalls in Senate: Bitcoin's Regulatory Status Unchanged Despite Brief Market Jolts
The US Senate's failure to advance the CLARITY Act has caused brief market jolts, but Bitcoin's regulatory status remains unchanged. The bill, which would have codified the definition of digital commodities and a framework for spot-market oversight and registration, fell short by 11 votes on September 15. According to BitPlanet Research Lab, this delay will create uncertainty around digital commodity regulation.
The report notes that the US Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) had previously identified Bitcoin as a digital commodity in March. This interpretation would not be reversed by the delayed legislation.
Despite the brief market volatility, with spot Bitcoin exchange-traded funds seeing $450.4 million in net outflows and Coinbase and Circle experiencing declines, Bitcoin recovered to its $80,000 level on September 18. The report suggests that investors should monitor follow-up rulemaking by the SEC and CFTC.
BitPlanet Research Lab expects the delayed bill to have a limited effect on Bitcoin's regulatory standing in the near term. However, they warn of prolonged regulatory uncertainty due to delays in putting spot-market oversight into law.
