Clarity Act Vote Looms Amid Ongoing Opposition and Ethics Concerns

The United States Senate is set to vote on the Clarity Act, sweeping cryptocurrency legislation that has been in the works for over a year. The bill aims to regulate the crypto industry comprehensively at the federal level, giving the Commodity Futures Trading Commission broader authority while also giving jurisdiction to the Securities and Exchange Commission.

Senate Republicans released a final draft of the bill late Sunday, addressing several sticking points in negotiations, but it is unclear whether the changes are enough for the bill to pass. The latest text gives state attorneys general a role in enforcing conflict-of-interest rules for public officials, amends the Blockchain Regulatory Certainty Act to remove references to a federal criminal statute, and gives the Treasury secretary authority to impose an 18-month 'circuit breaker' on stablecoin rewards.

The bill has been met with mixed reactions from lawmakers, with some Democrats waiving concerns about ethics and others expressing continued opposition. Sen. Elizabeth Warren led Democratic staff in the Senate Banking Committee in an analysis of the latest version of the bill, arguing that it would not prevent President Trump from making more money in crypto due to lack of enforceable ethics provisions.

The fate of the Clarity Act remains uncertain, with some predicting a 25% chance that it becomes law this year. The bill would still need to go back to the House for approval, which has been on recess since September.
