CLARITY Act's 60-Vote Hurdle: Democrats Block Cloture Over Ethics Enforcement and Stablecoin Yield

The CLARITY Act is at risk of failing to reach its required 60 votes in the Senate before August recess, according to Democrats. They are blocking cloture on the bill unless Republicans make progress on three unresolved disputes: ethics enforcement, illicit finance provisions, and stablecoin yield.

Democrats have coalesced around a firm position that without movement on these issues, a Senate cloture vote this week will fail. They are not persuadable by crypto industry spending at this stage, indicating that lobbying pressure has hit diminishing returns.

The three disputes blocking the bill's passage include ethics enforcement, which centers on empowering state attorneys general to sue the Department of Justice if it fails to enforce new conflict-of-interest rules. The White House has yet to respond to a bipartisan counter-proposal put forward by Senators Thom Tillis and Ruben Gallego.

Another point of contention is illicit finance, with critics arguing that certain DeFi and innovation-exemption provisions could allow decentralized protocols to route payments outside standard Bank Secrecy Act coverage. Treasury Secretary Scott Bessent has pushed back against these concerns, saying the bill simply codifies existing DOJ and Treasury policy on non-custodial builders.

The stablecoin yield question adds a third friction point, with Democrats flagging that certain bill language could allow stablecoin issuers to offer yield through exchange-reward structures, effectively circumventing the yield prohibition embedded in the GENIUS Act.
