WSJ Editorial on CLARITY Act Sparks Pushback from Crypto Leaders

The Wall Street Journal's editorial board recently expressed opposition to the CLARITY Act, citing concerns that Congress often passes legislation with policy landmines. However, crypto leaders have pushed back against these claims, arguing that they run counter to what the bill actually says.

Crypto lawyers and experts spent the day fact-checking specific lines from the WSJ editorial, which raised three main objections to the CLARITY Act. The first objection argued that stablecoin issuers could get around the GENIUS Act's ban on paying interest by striking deals with exchanges to hand out 'rewards'. However, crypto leaders pointed out that this would not be a loophole, but rather a compliance mechanism.

The WSJ editorial also claimed that decentralized networks would dodge anti-money-laundering and know-your-customer rules by operating like eBay. However, experts argued that decentralized systems with a controlling operator already fail the bill's own test for what counts as DeFi, and therefore get regulated as an intermediary.

The bill's path through Congress remains uncertain, with prediction markets putting its chances at roughly 23 percent as of August 5, down from near 70 percent earlier this year. Talks between Senator Thom Tillis and Senator Ruben Gallego over ethics provisions have stalled, with the White House yet to respond to a counteroffer.
