Clarity Bill Should Not Be Overhyped: Former CFTC Chairman Chris Giancarlo

Former CFTC Chairman Chris Giancarlo warns that the cryptocurrency industry should not overestimate the impact of the Clarity bill, pending in Congress. He believes innovation will continue regardless of its passage or failure.

The Clarity Act, which addresses digital asset market structure, passed the House of Representatives on July 17, 2025, but has stalled in the Senate without a floor vote after a Banking Committee review.

Giancarlo pointed out that if the bill ultimately fails, 'the gap could widen between companies that have continued building and those that have not.'

He also raised concerns about an expansion of surveillance, citing a problematic structure in the Clarity Act that brings cryptocurrency transactions under Bank Secrecy Act monitoring.
