Clarity Bill Stall Boosts Crypto Market with Swift SEC Action
Bitwise, a blockchain and cryptocurrency analysis firm, believes that the recent stalling of the Clarity bill in the U.S. Senate has had a positive impact on the market.
The bill aimed to provide regulatory clarity for digital assets, but its failure instead led to swift action from the Securities and Exchange Commission (SEC). The SEC issued a conditional exemption allowing tokenized U.S. listed stocks to be traded through automated market makers and liquidity pools, excluding trading venues from the definition of an exchange for a set period.
Matt Hougan, Bitwise's chief investment officer, noted that this move could delay regulatory issues tied to tokenization if the Clarity bill had passed. He also highlighted that stablecoins benefited from the bill's failure, as it left room under the existing framework for exchanges like Coinbase to continue offering rewards on customers' stablecoin holdings.
Hougan pointed out that regulatory uncertainty around revenue-generating tokens has eased somewhat due to an SEC FAQ document explaining that announcing a buyback plan related to tokens would not constitute an investment contract. However, he also noted that administrative actions can change depending on future administrations, and the current regulatory direction could shift if stricter leadership is appointed at the SEC and Commodity Futures Trading Commission.
