Crypto Fails to Wait for Congress, Turns to Regulators for Clarity

The crypto industry has shifted its focus from Congress to federal regulators after the Senate failed to advance the Clarity Act, a sweeping market-structure bill. The bill's collapse redirected rulemaking efforts, with regulatory agencies moving quickly to fill the vacuum.

Within 48 hours of the bill's failure, the SEC unveiled an innovation exemption for digital assets, allowing qualifying venues to trade tokenized U.S. stocks on-chain without registering as national securities exchanges. The CFTC issued a no-action position letting passive software providers give users access to regulated derivatives without registering as introducing brokers.

The Federal Reserve proposed rules requiring stablecoin issuers to fully back their tokens with safe, liquid assets and hold capital against operational risks. Industry figures have largely made peace with the regulatory path, but note that agency rulemaking is slower, easier to challenge in court, and easier for a future administration to unwind than a law.

Solana Policy Institute President Kristin Smith said the sector is 'now looking to regulators for guidance,' calling it 'the more viable path forward right now.' However, this shift also means that the industry will have to take what it can get from rules delivered by previously hostile regulators instead of a potentially industry-friendly Congress.
