The Democrats have secured control of both the U.S. House of Representatives and the U.S. Senate in the midterm elections, with 258 seats in the House and 54 in the Senate. This shift in power could significantly impact crypto regulation in 2027, as the Democrats may not prioritize crypto legislation as much as the Republicans did under President Donald Trump.

Trump had issued executive orders advocating for crypto and directed Congress to pass legislation to regulate the industry. While the GENIUS Act, which creates a regulatory framework for stablecoins, passed, the Clarity Act, aimed at establishing broader crypto regulations, has stalled. Democrats have pushed for additional ethics provisions, which could further delay or prevent the passage of the Clarity Act.

Analyst Jaret Seiberg from TD Cowen noted that Democrats are likely to investigate Trump's crypto entanglements, which could sour the political environment for crypto. This suggests that significant crypto legislation may be put on the back burner for the next two years, as Democrats focus on other priorities like checking Trump's power and addressing affordability issues.

Despite the potential legislative stall, pro-crypto regulators appointed by Trump still have the autonomy to pass favorable rules. However, the overall regulatory environment for crypto may become more challenging under the Democratic-controlled Congress.
