Emmer Sees Path for CLARITY Act Despite Senate Defeat
House Majority Whip Tom Emmer is optimistic that the CLARITY Act can still become law in 2026, despite its recent setback in the Senate. The bill, which aims to regulate the crypto market and address contentious issues such as stablecoin rewards, decentralized finance, and regulatory authority, failed to advance with a 50-49 vote on Tuesday. However, seven Democratic senators who opposed advancing the current version have since said they remain committed to negotiating crypto market-structure legislation.
Emmer pointed out that the procedural vote does not necessarily kill the bill and suggested that it could get another shot at becoming law after the November midterms. He noted that the post-midterm lame-duck session could provide a new window for the legislation, but acknowledged that the congressional calendar is now the biggest obstacle.
The Senate's failure to advance the CLARITY Act means that the bill faces several steps before it can reach President Donald Trump's desk. Any Senate version differing from the House-passed bill would have to return to the House or go through reconciliation, and even then, passage is far from guaranteed.
