ESMA Sounds Alarm Over Crypto-Asset Integration Risks

The European Securities and Markets Authority (ESMA) has sounded an alarm over the growing integration of crypto-assets into traditional finance. In its latest risk monitoring report, ESMA identified vulnerabilities in tokenized equities, DeFi protocol exploits, and prediction platforms.

The watchdog warned that the expansion of tokenized equities could amplify systemic risks due to their technical infrastructure introducing non-traditional participants who may reshape clearing and settlement structures in conventional markets.

ESMA also highlighted the issue of decentralized event contract platforms, where digital assets are used in betting and prediction platforms, hindering the detection of insider trading and coordinated market manipulation tactics.

The regulator's warning coincides with a period of legal confrontation in the United States regarding the regulatory framework applicable to these instruments. The Commodity Futures Trading Commission (CFTC) has issued regulatory guidance to defend its exclusive jurisdiction over event contracts traded under a federal regime, while state attorneys general and regulatory bodies have challenged this authority.

The dispute centers on whether transactions recorded on decentralized platforms should be classified as financial derivatives subject to federal supervision or fall under local gambling and betting laws. The issue is set to define operational oversight for the sector over upcoming legislative cycles.
