Esper's Warning: Clarity Act Could Be Bullish for Crypto as Senate Vote Looms
The U.S. Senate's upcoming vote on the Clarity Act could have significant implications for the cryptocurrency sector. Former Secretary of Defense Mark Esper has argued that passing the bill is a national security issue, as it can bolster or detract from the relative position of the U.S. in the global financial order.
Esper, who now serves as an advisor to Coinbase, believes that without guidance and guardrails provided by legislation, crypto capital might flow to jurisdictions where rules are clearer for financial institutions. This could potentially benefit countries like China, which Esper identifies as a long-term competitor.
The Clarity Act would require exchanges, brokers, and other financial institutions to comply with anti-money laundering (AML) and know-your-customer (KYC) regulations, helping to control the off-ramps stolen funds might use to escape after a breach. This could lead to fewer hacks resulting in permanent losses of funds.
If passed, the bill would likely benefit chains with decentralized finance (DeFi) ecosystems, such as Solana and Ethereum, as well as Bitcoin. However, investors should be cautious, as disagreements over key issues like ethics reforms may push the actual vote into 2027 or even lead to the bill being dropped altogether.
