Hive Battles Swedish VAT Charges Over Crypto Mining Activities
Hive Digital Technologies is locked in a tax dispute with the Swedish government over Value Added Tax (VAT) charges on crypto mining activities.
The controversy stems from changes made by the Swedish Tax Agency, which reclassified Hive's subsidiaries as mining Bitcoin and other cryptocurrencies on their own behalf, rather than providing computing power services to customers under contract.
This reclassification has significant financial implications for Bikupa Datacenter AB and Bikupa Datacenter 2 AB, two Hive Technologies subsidiaries located in Sweden. According to Dentons, the law firm representing Hive, the classification of these activities as outside the scope of VAT or exempt from VAT recovery can have a substantial financial effect on data center businesses.
Hive is seeking to elevate this complaint to the European Commission, alleging that Swedish courts have failed to provide reasons for their refusal to refer the question to the Court of Justice of the European Union (CJEU). This could set a precedent for similar disputes in the region if the European Commission chooses to investigate further and take action.
